Terms of Use

These Terms of Use (“Terms”) are a legal agreement between you and TryAllKinds (“ChompChart,” “we,” “us,” or “our”) governing your use of the ChompChart iOS app and related services (the “App”). By downloading or using the App, you agree to these Terms. If you do not agree, do not use the App.
1. Eligibility & account
You must be at least 13 years old (or the minimum age of digital consent in your jurisdiction) to use the App. By using the App, you represent that you meet this requirement and that any information you provide is accurate.
2. License to use the App
Subject to these Terms, we grant you a personal, limited, non-exclusive, non-transferable, revocable license to download and use the App for your own personal, non-commercial use on Apple devices you own or control, consistent with the App Store Terms of Service.
3. Subscriptions & billing
ChompChart’s core features are free. ChompChart Plus unlocks optional AI photo and voice logging and is offered as an auto-renewing subscription.
- Billing by Apple. All purchases and subscriptions are processed and billed by Apple through your Apple ID account. We do not handle or store your payment information.
- Auto-renewal. Your subscription renews automatically at the then-current price for the same period unless you cancel at least 24 hours before the end of the current period. Your Apple ID account is charged for renewal within 24 hours prior to the end of the current period.
- Price & term. The price, billing period, and any free-trial or introductory offer are shown in the App and at the point of purchase before you confirm.
- Managing your subscription. You can view, change, or cancel your subscription in your Apple ID Subscriptions settings.
4. Cancellation & refunds
You may cancel your subscription at any time through the App Store: open Settings > your name > Subscriptions on your device, select ChompChart, and choose Cancel. Cancellation takes effect at the end of the current billing period, and you keep access to Plus features until then. See our Support page for step-by-step instructions.
Payments are handled by Apple, and refunds are subject to Apple’s policies. To request a refund, visit reportaproblem.apple.com. We generally cannot issue refunds directly for App Store purchases.
5. Not medical advice
ChompChart is a general wellness and food-tracking tool. It does not provide medical, clinical, dietary, or nutritional advice, diagnosis, or treatment, and is not a substitute for professional advice. Always consult a qualified healthcare provider or registered dietitian before making decisions about your diet, especially if you have a medical condition, are pregnant or nursing, or have an eating disorder. Never disregard professional advice because of something in the App.
6. AI & nutrition estimates
Calorie and macronutrient figures in the App — including those generated by AI photo logging, AI voice logging, barcode lookups, and database searches — are estimates for informational purposes only. AI-generated results may be inaccurate or incomplete, and food databases may contain errors. You are responsible for reviewing and adjusting any estimate before relying on it. We make no guarantee as to the accuracy of any nutrition data.
7. Acceptable use
You agree not to: (a) reverse engineer, decompile, or attempt to extract source code from the App except as permitted by law; (b) use the App to violate any law or third-party right; (c) interfere with or disrupt the App or its underlying services; (d) abuse, overload, or attempt to gain unauthorized access to our systems or service providers; or (e) misuse AI features by submitting unlawful or infringing content.
8. Intellectual property
The App, including its software, design, branding, and the “ChompChart” name and logo, is owned by us or our licensors and is protected by intellectual-property laws. Except for the license granted above, these Terms do not transfer any rights to you. Your own logged content remains yours.
9. Third-party data & services
The App incorporates data and services from third parties, including Open Food Facts (nutrition data © Open Food Facts contributors, licensed under the ODbL), USDA FoodData Central, Apple (iCloud, HealthKit, the App Store), and Cloudflare (Workers AI). Your use of those features may be subject to the respective providers’ terms, and we are not responsible for third-party data or services.
10. Disclaimer of warranties
To the fullest extent permitted by law, the App is provided “as is” and “as available,” without warranties of any kind, whether express, implied, or statutory, including warranties of merchantability, fitness for a particular purpose, accuracy, and non-infringement. We do not warrant that the App will be uninterrupted, error-free, or that nutrition data will be accurate.
11. Limitation of liability
To the fullest extent permitted by law, in no event will TryAllKinds, its affiliates, or its suppliers be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, data, goodwill, or health outcomes, arising out of or relating to your use of (or inability to use) the App, even if advised of the possibility of such damages. To the maximum extent permitted by law, our total aggregate liability for all claims relating to the App will not exceed the greater of (a) the amount you paid us for the App in the twelve (12) months before the claim, or (b) US $50. Some jurisdictions do not allow certain limitations, so some of the above may not apply to you.
12. Indemnification
You agree to indemnify and hold harmless TryAllKinds and its affiliates from any claims, damages, liabilities, and expenses (including reasonable legal fees) arising from your misuse of the App or your violation of these Terms or applicable law.
13. Termination
You may stop using the App at any time and delete it from your device. We may suspend or terminate your access if you violate these Terms or if required by law. Sections that by their nature should survive termination (including intellectual property, disclaimers, limitation of liability, and governing law) will survive.
14. Governing law
These Terms are governed by the laws of the United States, without regard to conflict-of-laws rules. You agree that any dispute will be resolved in a court of competent jurisdiction in the United States, except where applicable law gives you the right to bring a claim in your home jurisdiction.
15. Apple-specific terms
These Terms are between you and us, not Apple. Apple is not responsible for the App or its content. Apple has no obligation to provide maintenance or support for the App. In the event of any failure of the App to conform to any applicable warranty, you may notify Apple, and Apple may refund the purchase price (if any); to the maximum extent permitted by law, Apple has no other warranty obligation with respect to the App. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you. You represent that you are not located in a country subject to a U.S. Government embargo and are not on any U.S. Government restricted-parties list.
16. Changes to these Terms
We may update these Terms from time to time. We will update the “Last updated” date above and, where appropriate, provide notice in the App. Your continued use of the App after changes take effect constitutes acceptance of the revised Terms.
